SHAH ALAM, Nov 3 — PAS MP Khalid Samad today called on the Selangor government to conduct a review and study of the state’s Islamic laws, with specific references to the issue of permits or “tauliah” which is currently a requirement in order for an individual to conduct a sermon or religious lectures.
At a press conference this morning, he said recent events involving former Perlis mufti Dr. Mohd. Asri Zainul Ariffin’s arrest and his own case had prompted him to issue this statement to his Pakatan Rakyat (PR) colleagues.
“Pakatan Rakyat has a responsibility to change their administration, so that it won’t be like the past Umno state government, which had a totally different take on Islam... which was repressive,” said Khalid.
Khalid, who is also Shah Alam MP, said that the basis of issuing permits to religious figures so they can conduct sermons “reeked of politics” and that the enactment needs to be reviewed and reassesed, as Pakatan Rakyat should be pushing for reform and change.
“I conducted a sermon at the Section 19 Al-Huda Mosque, and the next thing I know I received a letter from Selangor police stating that I did not have a permit to do so,which was strange because I had previously obtained a temporary permit from Jais,” said Khalid.
According to him, Jais had interviewed him last year and he had received the temporary tauliah or permit on July 10, 2008 to teach and preach.
“Then I get a letter from the police stating that my permit cannot be changed to a permanent one and my current one had to be cancelled as well because I supposedly had a criminal record.”
The Shah Alam MP was puzzled as to the criminal record as he was not aware he had one.
However, a check with Bukit Aman revealed that the office did not issue him a letter regarding the criminal offence which prevented him from obtaining the official permit.
“When I asked them to provide details of my alleged offence, they refused by saying that I needed to go through Jais in order to obtain the information.
“Why should Jais enquire for me as it is my own “criminal record?” said Khalid who was perplexed as to why there was so much confusion and lack of transparency in the matter.
“There is a rumour that the SMS sent by the Jais high official instructing law enforcers to look into my case was also sent to the Shah Alam Umno division chief, and that he was also the one who had issued a complaint on my sermon,” said the PAS man, who alluded that Jais’ credibililty might be questionable as the existing enactments are politically motivated and serve Umno’s interests.
Khalid called on the Selangor government to study and redefine the current laws surrounding permits, and also the anti-beer laws as these laws are repressive and do not reflect the freedom that Pakatan Rakyat represents.
“What happened to Dr Asri should not have happened in a Pakatan Rakyat-led state. Enactments that were approved by the previous BN government were based on repressive philosophies and we cannot be tied down to that system of governance.”
He added that there was a strong possibility that Dr Asri’s arrest was politically motivated in falsely portraying Pakatan Rakyat Selangor as being repressive.
The former Perlis Mufti was recently arrested for conducting a sermon without a permit.
Jais on their part has strongly denied any political motivations in the maverick religious scholar’s arrest.
Khalid has also instructed his lawyers to issue a notice to the Bukit Aman police to provide details on his case. If they do not respond, he will take the matter to court.
“People voted for us because they wanted to see change. What’s the point of us being here if we continue to run things the way they (BN) did?”

Benda ni senang je sebenarnya, budak skolah darjah 2 pun boleh nampak sekiranya diterangkan. Fakta-faktanya ialah.
1. PR memerintah Selangor
2. JAIS berada dibawah PR Selangor
3. PAS mempunyai Exco yg menjaga hal ehwal agama dan istiadat - termasuk JAIS
4. JAIS beri tauliah sementara kpd YB Khalid selepas menang PRU 2008 (sebelum ini mmg takde chance la nk dpt tauliah sbb yg control BN)
5. Tauliah tersebut cuba ditarik balik atau tidak di renew
Buat la kesimpulan sendiri, malas aku nak ajar korang ni! Kalau tak nampak juga pergi masuk skolah balik, start semula dari darjah satu.
Sebab itu walaupun saya menyokong PAS dari dulu tetapi dari krisis perlembagaan yang dicetus olih TUN Dr M dulu,saya amat sokong sehingga kini.
I'm sorry you had to endure this with Jais and PDRM on matters that should have been strictly between yourself and God.
By now many Muslims, with the non-Muslims, already realize the Umno-run government has been making Islam out to be more repressive and irrational than it really should be.
And together we voted for Change on March 8. If we keep this in mind, this incident is but part of our struggle for a better Malaysia. We're glad to have leaders like you at the forefront.

YB Khalid, saya rasa PAS sendiri pernah mengalami masalah nak beri kuliah zaman UMNO kerana tak ada tauliah, mengapa tak mansuhkan atau pinda, sejak mula berkuasa tahun lepas?
Ingat senang nak buang Pengarah JAIS.... ingat lagi apa jadi di Perak & penang?
Cubalah bayangkan jika Dr Yusof Qaradhawi datang ke Shah Alam dan JAIS tangkap sebab tak ada tauliah! Semua ulama muka di muka bumi ni pastinya sinis memandang Malaysia!
Mungkin PAS masih lemah untuk membuat pembaikan dalam pentadbiran!

Happy wishes from me and thank you for your patience when facing with so much hurdles both from within and out of your party.
The arrest of Dr. Asri happens about the same time when PAS says they want to take action against problematic leaders, which includes Dr. Hasan, the exco in charge of religious affairs in Selangor.
Its very clear that Dr. Hasan, together with Umno is the hidden hand in this matter as he is hell bent to show that he can do what he wants and there is nothing Pakatan could do about it. He is indirectly challenging PAS and Pakatan to sack him as he knows Pakatan and PAS don't have the guts to do so, especially after the defection og the Port Klang assemblyman.
So the burden is now on you and some of your like minded colleagues to prove that PAS IS REALLY FOR ALL.
1. Fahaman mereka terlalu liberal
2. Mereka bersetuju untuk melaksanakan p/raya PBT sedangkan PAS Pusat tidak merestuinya. Hassan berhujah jika ianya dilaksanakan, maka orang Melayu di Sabak Bernam dan Kuala Selangor lah yang akan menjadi majoriti ahli majlis PBT. Khalid dan Saari berhujah “let got it, kita perlukan ahli-ahli majlis yang berwibawa dan layak untuk menduduki kerusi ahli majlis”.
3. Isu bantuan kerajaan negeri terhadap sekolah swasta/agama. Mereka bersetuju dengan cadangan exco DAP untuk menyamaratakan bantaun tersebut.
4. Isu ganti tanah kepada kuil-kuil. Jika didapati ada kuil-kuil yang haram dan hendak dirobohkan, maka kerajaan negeri hendaklah menggantikan dengan tanah yang baru. Termasuk lah tanah-tanah yang dimiliki oleh MAIS. Mereka bersetuju.
5. Isu pembinaan Pusat Kebudayaan Cina di sebelah masjid baru yang dibina di suatu tempat. Pada mulanya tanah tersebut hanyalah 2-5 ekar tetapi diminta oleh exco DAP tambahan tanah sehingga menjadi 15-18 ekar tanah yang bernilai RM 3.8 juta (kalau tidak silap). Mereka bersetuju.
6. Penguatkuasaan enakmen Islam. Mereka tidak bersetuju kerana ianya merupakan enakmen zaman UMNO memerintah. Hassan berhujjah enakmen itu adalah berkaitan tangkap khalwat, zina, yang bercumbu-cumbuan, orang minum arak etc. Beliau dengan sinis mengatakan “tak kan perkara ini pun tidak boleh sedangakn enakmen yang hendak dikuatkuasakan itu adalah standard dengan negeri-negeri lain”.
Hassan juga mendedahkan tentang pendirian DAP yang tidak sesekali akan menerima enakmen Islam walau apapun yang berlaku.
Beliau menceritakan terdapat cadangan daripada exco DAP untuk membuat IT International Zone (kalau tidak silap) iaitu salah satu fungsinya adalah tempat untuk hiburan bertaraf antarabangasa seperti hiburan 24 jam, kelab malam 10mlm-4pg, kedai arak etc. Cadangan tenpat adalah di Puchong dan Shah Alam. Hassan berhujah dalam meting exco bahawa armarhum Sultan sudah menitahkan Shah Alam dilarang dibuat perkara-perkara seperti itu.
Datuk Khalid, sila jawab tomahan Hassan Ali seperti yang di atas dalam siri ceramah roadshownya. Kam i rakyat marhaen hendak tahu benar atau tidak.

setahu saya tiap-tiap kali sembahyang dzohor kat surau saya adanya ceramah agama dan lazimnya penceramah adalah pro PAS.. ada tauliah ke dari JAIS saya tak pasti.. Yang saya pasti benda macam ni dah berlarutan semenjak BN memerintah Selangor lagi..
Yang saya pasti, dalam bab agama orang BN malas nak bising.. biarkan orang PAS menguasai surau dan masjid.. dah malas nak kecoh-kecoh pun..
Saya tertarik dengan komen YB mengenai sumpah cerai talak tiga sekiranya mana-mana wakil rakyat PAS berpaling tadah..Kiranya YB sokonglah dengan saranan ni, siap dengan sebut contoh Nabi Muhammad pun pernah bersumpah.. Betul ke begitu ?.. tunjuk sikit hadis mana yang YB pakai, saya pun nak mengkaji juga hal ni. Pandangan saya kalau begini pemimpin PAS dan wakil-wakil rakyat PAS berfikir, saya rasa mereka ni layak dibaling dengan selipar jepun, bangang tahap cipan
